Asbestos abatement requires specialty and licensed removal personnel, equipment, disposal sites, materials, and PPE

Many buildings contain asbestos which was used in materials such as, floor tile, floor tile mastic, exterior siding, spray-applied flame retardant, thermal system insulation, and in a variety of other materials. Asbestos was widely used as a thermal insulation around pipes and floor tile in industrial areas, school systems, government buildings, and many residential homes. Asbestos was also often a component of a type of flocked acoustic ceiling called popcorn ceiling or “cottage cheese ceiling”, until its production was banned in the US in 1978. However, the ban allowed installers to use up remaining stocks, so buildings built as late as 1986 could still have asbestos in their building materials. The only way to be sure if a material contains asbestos is to remove a sample and have it tested by a competent laboratory.

There are different regulations and methods of enforcement, when it comes to asbestos removal. It is extremely important to remember that prior to any asbestos removal procedures taking place; the client has a duty of care and must verify that the specialist removal contractor can provide proof of the following:

• License if licensing is required within the jurisdiction

• Specific asbestos public and employer liability insurance

• Worker training to include supervisor and contract manager training within the past 12 months

• Worker fit-testing and medical surveillance within 12 months

Lead abatement is remediation activity that reduces levels of lead particularly in the home environment and other public buildings where children may be present. Lead abatement activities are generally initiated to permanently eliminate lead-based paint hazards in order to reduce or eliminate incidents of lead poisoning.

Lead abatement may be undertaken in response to orders by state or local government. It requires specialized techniques that local construction contractors typically do not have. It includes activities such as lead-based paint inspections, risk assessments and lead-based paint removal.

In the United States, lead abatement activities are regulated by the United States Environmental Protection Agency. Lead abatement companies are governed by the EPA. The EPA requires individuals and firms that conduct lead-based paint activities, including abatement, to be licensed. The lead abatement company, its supervisors, and all of its workers have to take classes and receive a certificate of completion. State agencies work with the EPA to enforce state and Federal laws.

Lead abatement is distinguished from Renovation, Repair and Painting (RRP) programs, which are typically performed at the option of the property owner for aesthetic or other reasons, or as an interim control to minimize lead hazards. RRP programs are not designed to permanently eliminate lead-based paint hazards.

CFR maintains the appropriate levels of employer liability insurance, worker training, fit-testing, and a medical surveillance program.

The EPA issued a new regulation called ‘Renovation, Repair and Painting’ (RRP) regarding the renovation of residential housing and child-occupied buildings built before 1978 on April 22, 2008, which became effective on April 22, 2010. Under the rule, contractors performing renovation, repair and painting projects that disturb lead-based coatings (including lead paint, shellac or varnish) in child-occupied facilities built before 1978 must be certified and must follow specific work practices to prevent lead contamination. EPA’s RRP rule impacts many construction trades, including general contractors and trade contractors, painters, plumbers, carpenters, glaziers, wood floor refinishers and electricians. Activities performed by these trades can disturb lead-based paint and have the potential to create hazardous lead dust. For most individuals, eight hours of training is required. Beginning April 2010, all businesses engaged in renovation, repair or painting activities in homes, residential buildings, schools and childcare facilities built prior to 1978 must be certified, use certified workers, and follow specific lead-safe work practices to prevent lead contamination.

Molds are ubiquitous in nature and grow almost anywhere indoors or outdoors. The overall diversity of fungi is considerable. For example, the genus Aspergillus has at least 185 known species. Molds spread and reproduce by making spores, which are small and lightweight, able to travel through air, capable of resisting dry, adverse environmental conditions, and capable of surviving a long time.

Although molds can be found almost anywhere, they need moisture and nutrients to grow. The exact specifications for optimal mold growth vary by the species of mold. However, mold grows best in damp, warm environments. The availability of nutrients in indoor environments rarely limits mold growth because wood, wallboard, wallpaper, upholstery, and dust can be nutrient sources. Similarly, the temperature of indoor environments, above freezing and below the temperature for denaturing proteins, can support mold growth, even if the actual temperature is not optimal.

The primary factor that limits the growth of mold indoors is lack of moisture. Substantial indoor mold growth is virtually synonymous with the presence of moisture inside the building envelope. This intrusion of moisture might be from rainwater leaking through faulty gutters or a roof in disrepair, from a foundation leak, from condensation at an interface (e.g., windows or pipes), or between a cold and a warm environment. Water also can come from leaks in the plumbing or sewage system inside the structure.

The most effective way to eliminate mold growth is to remove it from materials that can be cleaned and to discard materials that cannot be cleaned or are physically damaged beyond use. CFRC provides the appropriate initial PPE when performing clean-up or other activities in mold-contaminated homes or buildings after a flood.

HAZWOPER (Hazardous Waste Operations and Emergency Response)

On October 17, 1986, former President Reagan signed into law the Superfund Amendments and Reauthorization Act of 1986 (SARA) As part SARA, OSHA was required to promulgate regulations which were to provide protection for employees engaged in Hazardous Waste Operations and Emergency Response (HAZWOPER). Congress also required the U.S. Environmental Protection Agency (EPA) to issue regulations identical to the OSHA HAZWOPER regulations.

The Hazardous Waste Operations and Emergency Response Standard (HAZWOPER) applies to five distinct groups of employers and their employees. This includes any employees who are exposed or potentially exposed to hazardous substances — including hazardous waste — and who are engaged in one of the following operations

  • Clean-up operations — required by a governmental body, whether federal, state, local, or other involving hazardous substances — that are conducted at uncontrolled hazardous waste sites;
  • Corrective actions involving clean-up operations at sites covered by the Resource Conservation and Recovery Act of 1976 (RCRA) as amended (42 U.S.C. 6901 et seq.);
  • Voluntary clean-up operations at sites recognized by federal, state, local, or other governmental body as uncontrolled hazardous waste sites;
  • Operations involving hazardous wastes that are conducted at treatment, storage, and disposal facilities regulated by Title 40 Code of Federal Regulations Parts 264 and 265 pursuant to RCRA, or by agencies under agreement with U.S. Environmental Protection Agency to implement RCRA regulations; and
  • Emergency response operations for releases of, or substantial threats of releases of, hazardous substances regardless of the location of the hazard.
